Article 1 : Préambule
Les présentes conditions générales définissent les droits et obligations de la vente de biens et services sur Internet entre :

Toutes ces informations sont présentées en français. Le Client déclare avoir la pleine capacité juridique pour s’engager au titre du présent contrat.
Article 2 : Objet et champ d’application
Les présentes conditions générales expriment les droits et obligations réciproques des parties. Elles prévalent sur toutes autres conditions figurant dans tout autre document, sauf dérogation préalable, expresse et écrite.
Si une condition devait faire défaut, elle serait considérée comme régie par les usages en vigueur dans le secteur de la vente à distance des sociétés ayant leur siège en France.
Conformément à la loi du 13 mars 2000 relative à la signature électronique et à la loi pour la confiance dans l’économie numérique du 21 juin 2004, la validation de la commande s’effectue par « double clic » et constitue une signature électronique qui a, entre les parties, la même valeur qu’une signature manuscrite. Toutefois, le Client peut décider d’exercer son droit de rétractation tel que stipulé à l’article 8 des présentes conditions générales de vente.
Ces conditions générales de vente sont susceptibles d’être modifiées, les conditions applicables sont celles en vigueur sur le site à la date de passation de votre commande.
Article 3 : Produits
Les produits et services proposés à la vente par wardashopp peuvent être des articles de toute nature.
Ils sont conformes à la législation française en vigueur et aux normes applicables en France. Les offres avec leurs prix sont valables tant qu’elles sont visibles sur le site, dans la limite des stocks et sous réserve de disponibilité auprès de leurs fournisseurs.
Wardashopp s’efforce de décrire et de présenter le plus fidèlement possible les caractéristiques essentielles des produits. Les photos des produits ne sont pas contractuelles et le produit ne comporte pas nécessairement tous les éléments de la photo.
Article 4 : Prix
Wardashopp se réserve le droit de modifier ses prix à tout moment, mais les produits seront facturés sur la base des prix en vigueur au moment de la validation des commandes.
Les prix indiqués sur les fiches produits s’entendent toutes taxes comprises, hors frais de port. Les frais de port, calculés automatiquement par wardashopp en fonction du montant de la commande et du pays de livraison, sont indiqués avant la validation de la commande par le Client. La TVA n’est pas applicable selon l’article 293B du CGI.
Le prix total à payer dans le formulaire de commande comprend le prix des produits avec les remises et options possibles et la participation aux frais d’expédition:
- pour une livraison en France et dans les autres pays de l’Union Européenne, les prix sont nets, la TVA n’est pas applicable selon l’article 293B du CGI.
- pour une livraison hors Union Européenne, les prix sont nets, TVA non applicable selon l’article 293B du CGI. Le Client devra payer dans le pays du lieu de livraison les droits de douane, TVA ou autres taxes dus à l’occasion de l’importation. La vérification des droits et les formalités y afférentes relèvent de la responsabilité exclusive du Client.
Article 5: Order - Invoice
Orders can only be placed on the wardashopp website
In order to take into account the order, the Customer agrees to provide the information requested and undertakes to ensure that it is accurate. In case of error, wardashopp cannot be held responsible.
The validation of the order is done by "double click" in accordance with the law, with prior display of the basket and then the numbered order form which summarizes all the contractual elements of the order.
The processing of the order by wardashopp includes the following steps:
- sending by email of an acknowledgement of receipt of the order; orders will be processed in the order in which they are actually received.
- additional validation of the Customer's payment, in order to limit the risks of fraud and thus protect the Customer's interests.
- Sending by email of a notice of shipment of the order; the ordered products are sent to the delivery address that the Customer has indicated at the time of his order. The delivery note is attached to the package.
- The original invoice for the order is available on the website, in the Client's private area, with the order history.
Wardashopp reserves the right:
- not to confirm an order for any reason whatsoever, including but not limited to a product supply problem or a problem with the order received,
- cancel any order from a Customer with whom there is a previous dispute.
The Customer can follow the process of his order and delivery on the site, in the private space of the Customer, in the Orders section. The Customer can consult or print the available information according to his needs.
Article 6: Payment
The price due by the Customer is the total price indicated on the order form and confirmed by the order acknowledgement. The price due is payable in cash at the time of the order in euros.
Payment by credit card and credit card number is encrypted on the Customer's computer and then transmitted directly and securely to the payment servers of the Paypal system (No. 1 worldwide for payment on e-commerce sites) without passing through the wardashopp server. The credit card number is therefore only known by the payment servers. At no time is the card number communicated to wardashopp.
The order validated by the customer will be taken into account only after receipt of payment within the time limits indicated above or after agreement of the bank payment center. In case of delay or refusal, the order will be automatically cancelled and the Customer informed.
In accordance with the provisions of Law No. 80 335 of May 12, 1980, the products ordered remain the property of wardashopp until final and full payment of their price.
Article 7: Delivery
The products are prepared and shipped according to the validated order, unless specifically indicated on the product sheet, restocking in progress or unavailability of the product (count 5 to 15 working days).
The delivery times between 5 and 10 days.
- For products not stocked in our warehouses, our offers are valid subject to availability from our suppliers. This information comes directly from our suppliers, errors or exceptional changes are beyond our control and can not engage our responsibility.
- When you place your order, we inform you of the availability of the products you wish to purchase. Nevertheless, if despite our vigilance, the products turn out to be temporarily or definitively unavailable, we will inform you by e-mail or by mail as soon as possible.
- In case of temporary out of stock on one of the products of your order:
we will ship the rest of your order, with an information message. The momentarily unavailable products will be put on hold. After 15 working days (date of order), if the article could not be delivered, it will be automatically refunded.
- In case of definitive product shortage after placing your order, we will propose you either the refund or the exchange of the product(s) in shortage of stock (proposal of a similar product by its price and its characteristics).
The geographical area of delivery corresponds to the countries of delivery available on the site during the order. The products are transported at the risk of the recipient, regardless of the mode of transport chosen.
For the delivery of the package, wardashopp (uses the most qualified professionals according to the type and volume of products to be transported, such as La Poste Colissimo Suivi with or without signature. The Customer will be notified by email of the shipment of his order.
In case of partial and unforeseen unavailability of products, wardashopp may have to split an order, without additional cost of shipping for the Customer.
The carrier delivers the package to the recipient, at the delivery address indicated by the Customer on the order form, against signature of the carrier's delivery slip.
In case of absence, the recipient receives a notice of passage from the carrier, with instructions for the delivery of the package within a period specified by the carrier. After this period, the package is returned by the carrier to wardashopp. If the Customer decides to proceed with a new delivery, it is at his expense and must be paid before the reshipment by contacting by email the Customer Service through the contact form of the site. For undelivered products, especially in case of refusal of delivery not motivated by the recipient, wardashopp reserves the right to refund the price of the order with deduction of actual shipping costs.
Upon delivery, the recipient is required to check, in the presence of the carrier, the condition of the package upon delivery.
In case of anomaly noted at the delivery (check the state of the box) or of any doubt on the contents of the order, the recipient must indicate his reserves in the form of handwritten and dated observations with his signature on the delivery slip and keep a copy. The recipient must refuse the package. He must then send his claims to the Customer Service by the contact form of the site, at the latest within one working day after delivery. He must also confirm this anomaly by sending the carrier within 2 working days after the delivery date a registered letter with acknowledgment of receipt stating the claims.
For packages marked FRAGILE, it is essential to report any breakage with the delivery person. No claim can be taken into account later.
In case of anomaly noted after unpacking the package (for packages without FRAGILE), the Customer must contact Customer Service through the contact form on the site, no later than the business day after delivery.
If the return is necessary, wardashopp will provide the Customer with instructions by email to return the product. The return form and the delivery note must be attached to the product. The product must be in perfect condition for resale, unused, properly protected, in its original packaging with all accessories, documentation and associated instructions intact and not handwritten. The product must be sent by the Customer by registered mail with acknowledgement of receipt or Colissimo Suivi to

The product will automatically be exchanged subject to availability or refunded if it was not available. The exchange costs are borne by WARDASHOPP, if there is an error except in the case where it turns out that the product does not correspond to the original statement made by the Customer in the return form.
Any anomaly that would not be processed by the Customer in the rules defined above and within the time limits could not be taken into account and will release wardashopp from any liability.
Delivery times are only indicative and wardashopp cannot be held responsible for any delay in delivery. Possible delays do not entitle the Client to claim damages.
However, except in cases of force majeure, if the delay exceeds the period of 30 days provided by the provisions of Article L 121.20.3 of the Consumer Code, the Customer is entitled to cancel the order. The amount paid by the Customer will be refunded in full, without additional compensation.
War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging the seller from his obligation to deliver. The goods always travel at the risk of the recipient.
Article 8: Right of withdrawal
The right of withdrawal applies after receipt of the package by the Customer.
The Customer can then return the purchased product(s) and ask for a refund, except for the shipping costs.
In accordance with the provisions of articles L121-16 and following of the Code of Consumption, the Customer has a period of 14 days from the date of receipt of his order, to return at his expense, the products ordered, for refund or exchange.
The returned product must be in perfect condition for resale. Our products must not have been unsealed, worn or stripped of their labels, so that the consumer can benefit from the right of withdrawal.
Only products returned as a whole, in their original packaging, complete and intact, and in perfect condition for resale will be accepted. Any product which will have been damaged, or whose original packing will have been deteriorated, will be neither refunded, nor taken back, nor exchanged. This right of withdrawal is exercised without penalty, with the exception of shipping and return costs. In the hypothesis of the exercise of the right of retractation, the consumer has the choice to ask either for a credit on the paid sums (except postal charges), or for the exchange of the product, or for the refund. In the case of an exchange, the reshipment will be at the expense of the consumer.
In case of exercising the right of withdrawal, wardashopp will make every effort to credit the consumer with a credit note or a refund within thirty days.
The returned product must be accompanied by :
- the invoice or delivery note corresponding to the purchase, with the reason for return handwritten on the document,

The cost of returning the product is the responsibility of the Customer.
If the package was expressly refused by the customer upon delivery without any anomaly being noted as provided in Article 7 above, the shipping costs incurred will be charged to the customer.
Within a maximum of 60 days from receipt of the returned product, WARDASHOPP will reimburse the Customer the amount of the invoice price of the product, excluding shipping costs. In case of incomplete or deteriorated condition of the returned product, wardashopp reserves the right to deduct up to 50% of this amount for product requalification costs.
Wardashopp will inform the Customer by email of the receipt of the returned product and of the refund made.
Article 8.1: Withdrawal on discount coupons and accumulation of discount coupons
Article 9: Warranty
The purchased products give right to the guarantee indicated on the card article of the products presented on the site.
For any problem on a product, the Customer must contact the Customer Service by the contact form of the site, which will assist the Customer in the procedure of After-Sales Service (return of the product).
In order to benefit from the product warranty, it is essential to keep the purchase invoice of the product, its original packaging and the manufacturer's warranty card if it is a material.
The warranty does not cover damage, breakage or malfunctions due to non-compliance with the precautions for use. In any case, the sold products benefit from the legal guarantee against the hidden defects envisaged by articles 1641 and following of the Civil code.
Article 10: Litigation
For any complaint, please contact the customer service at the postal or e-mail address of the Seller indicated in ARTICLE 1: Preamble
The Customer is informed that he can in any case resort to a conventional mediation, with the existing sectorial mediation authorities or to any alternative mode of settlement of the disputes (conciliation, for example) in case of dispute.
All disputes arising from the purchase and sale operations concluded in application of these GTC and which have not been amicably settled by the seller or by mediation, will be submitted to the competent courts under the conditions of common law.
Article 11: Legal information
The information of the personal information collected for the purposes of the remote sale is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. Failure to provide this information will result in the order not being validated. In accordance with the law " Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). The Customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him/her, which he/she can exercise by contacting wardashopp. Furthermore, wardashopp will not communicate, free of charge or in exchange for payment, the contact details of its customers to a third party.
This website is the property of wardashopp in its entirety, as well as all related rights. Wardashopp is the owner of the intellectual property rights on the site and the distribution of the elements of the catalog of the Internet store, in particular the photographs for which it has obtained the necessary authorizations. Any reproduction, integral or partial, is systematically subjected has the authorization of the owners. The photographs of the site are the property of their respective owners.
